1. Services Provided

iv. CRM, calendar, and workflow integrations

v. AI chat widgets and AI phone receptionist systems

vi. SMS, email, and communication automation setup

vii. Hosting, maintenance, and related digital services

Service scope is defined in individual client agreements, proposals, or invoices.

2. Client Responsibilities

Clients agree to:

i. Provide accurate information required for project completion

ii. Supply necessary content, branding materials, and approvals in a timely manner

iii. Maintain compliance with all applicable marketing, privacy, and communication laws when using systems delivered by the Company

iv. Ensure that all leads contacted through messaging systems have provided proper consent

Delays caused by missing client materials may extend delivery timelines.

3. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on the website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

i. modify or copy the materials;

ii. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

iii. attempt to decompile or reverse engineer any software contained on the website;

iv. remove any copyright or other proprietary notations from the materials; or

v. transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

4. Payments and Billing

All services are billed according to the pricing agreed upon in the proposal, invoice, or service agreement.

i. Payments for completed work are non-refundable once the deliverable has been provided or project access has been granted.

ii. Subscription or recurring services continue until canceled according to the cancellation terms provided at signup.

iii. Failure to maintain payment may result in suspension of hosted services, automations, or system access.

5. Refund Policy

Refunds may be considered only for services not yet started or materially delivered. Once a project has been completed, deployed, or access to systems has been provided, services are considered fulfilled and non-refundable unless otherwise agreed in writing.

6. Contractor and Third-Party Services

The Company may utilize independent contractors, subcontractors, or third-party platforms to fulfill portions of service delivery. While we take reasonable care in selecting providers, we are not responsible for outages, errors, or service disruptions caused by third-party platforms including hosting providers, CRM systems, communication platforms, or payment processors.

7. Messaging, SMS, and Communication Compliance

Clients using messaging systems configured by the Company agree that:

i. SMS, phone, and email communications must only be sent to individuals who have provided proper consent (opt-in).

ii. Message frequency may vary depending on campaign or workflow setup.

iii. End users must have the ability to opt out of communications at any time.

iv. Clients are solely responsible for how messaging systems are used once deployed.

v. Message and data rates may apply. End users may opt out at any time by replying STOP and may request assistance by replying HELP.

The Company is not liable for penalties, fines, or claims arising from improper use of communication systems by clients.

8. Description of SMS Use Cases

By submitting your phone number through our website forms or other opt-in methods, you expressly consent to receive SMS messages from NETSTONE LLC related to appointment reminders, service updates, customer service notifications, and marketing communications. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP and request assistance by replying HELP.

We do not sell, rent, or share mobile numbers or personal information with third parties for marketing purposes. Information collected through SMS opt-in is used solely for communication related to our services.

9. Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages.

10. Age Restriction

You must be at least 18 years old to use our messaging services.

We have not reviewed all of the sites linked to our website and are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us of the site. Use of any such linked website is at the user's own risk.

12. Intellectual Property

Upon full payment, clients receive the right to use delivered website designs, builds, and automation systems for their business operations. The Company retains the right to reuse non-confidential frameworks, templates, processes, and development methodologies for future projects.

13. Disclaimer of Warranties

All services and materials are provided “as is” without warranties of any kind, either expressed or implied. The Company does not guarantee specific business results, revenue increases, lead volume, or marketing performance outcomes.

14. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages including loss of profits, loss of data, or business interruption resulting from the use of our services, websites, or systems.

15. Service Modifications

We reserve the right to modify, update, or discontinue any service, feature, or offering at any time. Continued use of services after updates constitutes acceptance of revised terms.

16. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Michigan, and you irrevocably submit to the exclusive jurisdiction of the courts located within the State of Michigan.
